Introduction

UBQT L.L.C – FZ (“we” or “us” or the “Company”), as the operator of this application (the “App”) are committed to respecting your privacy. While we help you connect with your contacts and further develop meaningful connection, we collect, use, store, or share your personal information that you disclose when you access the Company’s App or the Services. Throughout this policy, you will understand the information we collect, why we collect it, how it is used and your choices regarding your information. This policy should be read in conjunction with the Company’s terms and conditions and further describes your privacy rights and how the applicable data protection laws protect you.

Scope of this Policy

This policy applies to websites, apps, events, and other services we operate on the App as accessed via your mobile device or computer under the brand UBQT. For simplicity, we refer to all of these as the “Services” in this policy. Some Services if accessed in a different country other than those mentioned above, may require their unique privacy policy. As such, if the Services are accessed in that particular countries, then that policy and not this policy applies.

What information do we collect?

Information you give us. When you use or access the Services, we will ask you to provide us with certain personally identifiable information (Personal Data) that can be used to use the Services and to provide a seamless experience for you to invite and connect with your friends on the App.

, contact or identify you. Personal Date may include, but is not limited to the following:

1. When you create an account, you provide us with at least your: First and last name, Email address, Phone number, live location details/geolocation data, date of birth, trip details like date of travel, destination city, and access to your contact list. After giving the App the contact list access permission, you can go to the contacts page and add your friends or invite them to join the App.

Where you provide such elements to us, you consent to us using it for the purposes identified and as laid out in this policy. You can also share additional information with us, such as details on your hobbies, interests, as well as content such as photos or videos. To add certain content, like pictures or videos, you may allow us to access your camera or photo album.

1. When you subscribe to a paid service or make a purchase directly from us (rather than through a platform such as iOS or Android), you provide us with information related to the purchases you make and our payment processors with information such as your debit or credit card number or other financial information.
2. When you participate in surveys, focus groups or market studies, you give us your insights into our products and services, responses to our questions and testimonials.
3. When you choose to participate in surveys, events, promotions, or contests, we collect the information that you use to register or enter.
4. If you contact our customer care team, we collect the information you give us during the interaction.
5. If you share with us information about other people (for example, if you use contact details of a friend for a given feature), we process this information on your behalf to complete your request.
6. We also process your chats with your contacts/connections on the App to operate and secure the services, and to keep our community safe.

Information we receive from third parties. Further, we also collect information about your use of the Services such as access logs, mobile device’s GPS as well as information from third parties, like when you access the Services through your social media account or when you upload information from your social media account to complete your profile.

In addition to the information that you may provide to us, we also collect information about you received from third parties like your contacts who are registered with the Services and wish to connect with you. When registered for the Services, we access your live location to determine and show you connections in the App or people in your contacts who are in the same location.  If you decide to login or sign up your account using social media like Facebook, Google or Apple; or from our partners where our ads are published, in which case they might share details, or a promotion or campaigns performed on our behalf.

We may collect information from and about the device(s) you use to access the Services, including software and hardware information such as IP address, device type and ID, application settings and characteristics, advertising IDs, app crashes (which are randomly generated numbers that you can reset by going into your device’s settings and, in some cases, disable entirely), and identifiers or other technologies that may uniquely identify a device or browser.

Use of Your Personal Data

The Company may use your Personal Data for the following purposes:

1. To provide and maintain the Services, including monitoring these Services. We use your contact list and live geolocation data to show people you know who could be nearby your current location or destination as per your trip details updated under your account in the App.
2. To manage your Account or your registration as a user of the Services. The Personal Data you provide gives you access to different functionalities of the Services that are available to you as a registered user.
3. For the performance of a contract, or its development, undertaking and compliance of the purchase contract for the Services that you have purchased or of any other contract you have with us through the Services.
4. To contact you via SMS, email, telephone calls, or other modes of electronic communication, such as an application’s push notifications regarding informative communications or updates related to the features or functionalities of the Services including but not limited to the security updates, when necessary or reasonable for their implementation.
5. To provide you with unique offers, news, and general information about the Services, and events which we offer that are like those that you might have purchased or enquired about unless you have opted-out to receive such information.
6. To manage your requests that you forward us.
7. For business transfers where we may use your information to facilitate or evaluate a merger, reorganisation, restructuring, dissolution, or any other transfer or sale of part or all the Company’s assets, whether as a going concern or as part of liquidation, or similar proceeding, in which Personal Data held by us about the Services is among the Company’s assets transferred.
8. For other purposes like identifying usage trends, data analysis, determining the effectiveness of our promotional/marketing campaigns and to evaluate and improve the Services or your experience.

We may share your Personal Data with:

1. Your contacts on the App who may wish to connect with you.
2. Service Providers to analyze and monitor your use of the Services or to contact You.
3. Business partners for purposes of negotiating of a business merger, sale of Company assets, financing, or acquisition of all or a portion of the Company’s business to another company.
4. the Company’s affiliates, in which case we will require those affiliates to honor this policy. Affiliates include the Company’s parent company, if any and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us.
5. the Company’s business partners to offer you certain products, services, or promotions.
6. other users when you have shared Personal Data or interacted in the public areas with other users, such Personal Data could be viewed by all users or be publicly distributed outside. When you register through a third-party social media platform or interact with other users or, your contacts on the third-party social media platform may see your name, profile, pictures, and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you and view your profile.
7. With Your consent: We may disclose your Personal Data for any other purposes with your consent.

Your profile information is visible by users on the App who may request to connect with you.

Whenever you visit or use the Services and provide your Personal Data, you consent that the Company can use such data for the above purposes and that the Company is authorised to use or process your Personal Data in accordance with applicable laws.

Retention of Your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this policy. We will retain and use your Personal Data to the extent that it is necessary for us to comply with the Company’s legal obligations (for example, where we are required to retain your data to comply with the relevant applicable laws), enforce our legal agreements, resolve disputes, and other policies.

Transfer of Your Personal Data

Your information is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. This means that your Personal Data may be transferred to and/or maintained on computers located outside of your city, state, province, country, or other governmental/federal jurisdiction where the data protection laws may differ than those from your jurisdiction.

Your consent to this policy followed by your submission of such information represents your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other information about you.

Delete Your Personal Data

You have the right to access, review, delete or request that we assist in deleting the Personal Data that we have collected about You.

The Services may give you the ability to delete certain information about you from within the Services.

You may review, update, amend, or delete your information at any time by signing into your account, if you have one, and visiting the account settings section that allows you to manage your Personal Data. You may also contact us to request access to, correct, or delete any Personal Data that you have provided to us. Should you choose, you will no longer be able to use the Services.

However, please note that we may be required to retain certain information about you when we have a lawful basis or legal obligation to do so.

Disclosure of Your Personal Data

Business Transactions. If the Company is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We may provide notice before your Personal Data is transferred and becomes subject to a different policy.

Law enforcement. Under certain circumstances, the Company may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

Security of Your Personal Data

The Company is strongly committed to protecting your information and ensuring that your choices are honoured. We have taken strong security measures to protect your data from loss, misuse, unauthorized access, disclosure, alteration, or destruction. All sensitive data is stored behind multiple firewalls on secure servers with restricted employee access.

Legal Age

The Services are intended for persons of a legal age and above 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. Please contact us, if you become aware that a user below 18 has provided us with Personal Data. If we become aware that we have collected Personal Data from anyone under the age of 18, we will take reasonable steps to remove that information from the Company’s servers.

If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we may require your parent’s consent before we collect and use that information.

EU and EEA Users’ Rights

If you are habitually located in the EEA, you have the right to access, rectify, download, or erase your information, as well as the right to restrict and object to certain processing of your information according with the applicable General Data Protection Regulation. While some of these rights apply generally, certain rights apply only in certain limited circumstances. We describe these rights below:

You have the right to access your personal data and, if necessary, have it amended or deleted or restricted. In certain instances, you may have the right to the portability of your data. You can also ask us to not send marketing communications and not to use your personal data when we carry out profiling for direct marketing purposes. You can opt out of receiving email newsletters and other marketing communications by following the opt-out instructions provided to you in those emails. Transactional account messages maybe unaffected if you opt-out from marketing communications.

Changes to this Policy

We may update this policy from time to time. We will notify you of any changes by posting the new policy on this page.

We will let you know via email and/or a prominent notice via the Services, prior to the change becoming effective and update the “Last updated” date at the top of this policy.

You are advised to review this policy periodically for any changes. Changes to this policy are effective when they are posted on this page.
